Terms of service
LALALA FASHION — TERMS AND CONDITIONS
OVERVIEW
These Terms and Conditions (the “Terms”) govern your access to and use of the Lalala Fashion website and online store, together with the products, information, features and services made available through them (collectively, the “Services”). References to “Lalala Fashion”, “we”, “us” and “our” mean the business identified in Section 25. References to “you” and “your” mean the person accessing the Services or placing an order.
Our online store is hosted by Shopify, which provides the technology enabling us to offer the Services. The contractual relationship for purchases is between you and Lalala Fashion, as explained in Section 9.
Please read these Terms before placing an order and retain a copy for your records. Our Refund Policy supplements these Terms. Our Privacy Policy (https://lalalafashion.co.uk/policies/privacy-policy) explains how personal information is handled; it does not remove any rights you have under data protection law.
Particular attention should be given to Section 3A, which addresses personalised products and the restrictions on change-of-mind returns following dispatch. Nothing in these Terms removes any consumer right or remedy that cannot lawfully be excluded.
SECTION 1 — ACCESS AND ACCOUNT
1.1 You must have the legal capacity to enter into a binding contract when placing an order. If you allow a child or another person to use your account or device, you should supervise that use appropriately and must not permit unauthorised purchases.
1.2 You must provide accurate, complete and current information when registering an account, placing an order or contacting us. This includes your contact details, delivery address and any information necessary to authorise payment. Please notify us promptly of any error that may affect an order.
1.3 You are responsible for taking reasonable precautions to protect your account credentials. Please contact us promptly if you suspect unauthorised access. You must not sell, transfer or license your account to another person. This provision does not make you responsible for losses caused by a failure in our own security or for transactions for which the law does not make you liable.
SECTION 2 — OUR PRODUCTS
2.1 We take reasonable care to ensure that product descriptions, images and specifications accurately represent the products offered. Screen settings, lighting and display technology may affect the appearance of colours and textures. These potential differences do not remove our obligation to supply goods that conform to their description and meet applicable legal standards.
2.2 Embroidery previews illustrate the selected personalisation. The appearance of stitching on a finished textile may differ slightly from a digital rendering because of the material and embroidery process. A preview qualification does not excuse incorrect lettering, an incorrect selected option or a material departure from the agreed description.
2.3 We may update the product range, descriptions or availability for future orders. Such updates do not retrospectively change the specifications of an order already accepted without your agreement. Any applicable quantity limits or delivery restrictions will be communicated before an order is accepted.
SECTION 3 — ORDERS AND CONTRACT FORMATION
3.1 Submitting an order constitutes an offer to purchase the selected products and services on these Terms. An automated acknowledgement of receipt does not, by itself, constitute acceptance unless it expressly states otherwise. A contract is formed when we confirm acceptance of your order.
3.2 Acceptance is subject to payment being successfully processed and our ability to fulfil the order. Where we cannot accept an order, for example because a product is unavailable or payment cannot be authorised, we will inform you and refund any payment taken for the unaccepted order.
3.3 Please review the products, quantities, personalisation details and delivery information before submitting your order. If you discover an error, contact us promptly. Requests for amendments will depend on the status of the order and do not affect any cancellation or other rights available to you by law.
3.4 Returns, exchanges and cancellations are addressed in our Refund Policy https://lalalafashion.co.uk/policies/refund-policy and, for personalised products, Section 3A. For eligible non-personalised online purchases, statutory cancellation rights continue to apply. Neither our Refund Policy nor these Terms makes those rights dependent on our discretion.
3.5 Our store is intended for personal and household purchases. If you wish to purchase for commercial resale or export, please contact us before ordering so that we can confirm whether separate arrangements are required.
SECTION 3A — PERSONALISED ITEMS
3A.1 Scope
For the purposes of these Terms, personalised items are products embroidered with initials, names or other text selected by you and produced in accordance with the personalisation details submitted with your order.
3A.2 Returns, exchanges and refunds following dispatch
Subject to the statutory rights expressly preserved below, once a personalised item has been dispatched, we do not accept returns or exchanges, or provide refunds, where the request arises solely from a change of mind or personal preference. This restriction applies to both the personalised product and the associated personalisation charge.
3A.3 Accuracy of personalisation details
You are responsible for reviewing the accuracy and completeness of your selected text, spelling, initials, font, size and thread colour before confirming your order. Where we have correctly reproduced the details you supplied, an error in those details does not, in itself, entitle you to a change-of-mind return, exchange or refund. This provision does not exclude our responsibility for an error made by us or otherwise restrict your statutory rights.
3A.4 Requests before dispatch
If you wish to amend or cancel your order before dispatch, please contact us promptly at contact@lalalafashion.co.uk. We will assess your request with reference to the production and dispatch status of your order and confirm whether the requested amendment or cancellation can be accommodated. Any statutory right to a remedy remains unaffected.
3A.5 Faulty, damaged or incorrectly supplied goods
The restrictions in this section do not apply so as to exclude or limit your statutory rights where an item is faulty, damaged on delivery, not as described or incorrectly personalised by us. These rights are not confined to defects apparent or reported immediately upon arrival.
Please contact contact@lalalafashion.co.uk, providing your order number and a description of the issue, together with photographs where reasonably possible. We will assess the matter and provide the remedy required by applicable consumer law, which may include a refund, repair or replacement, depending on the circumstances. We will also meet reasonable return costs where required by law.
3A.6 Gift wrapping and preservation of rights
The addition of gift wrapping alone does not make an otherwise standard product a personalised item for the purposes of this section. Nothing in these Terms or our Refund Policy excludes, restricts or overrides any statutory consumer right or remedy that cannot lawfully be excluded or restricted.
SECTION 4 — PRICES, PROMOTIONS AND PAYMENT
4.1 Product prices and any applicable personalisation or gift-wrapping charges are displayed during the ordering process. Applicable taxes and delivery charges will be identified before you place your order. We will not add an optional service charge without your agreement.
4.2 Prices and promotions may change for future purchases. A subsequent price change does not alter the price of an accepted order. If a pricing error is identified, we will address it in accordance with Section 12 rather than automatically charging an increased amount.
4.3 Promotions may be subject to additional conditions, including eligibility criteria and expiry dates. Those conditions will be made available with the relevant promotion and apply to that promotion without restricting statutory rights.
4.4 You must be authorised to use the payment method provided and must supply accurate billing information. Payment is subject to authorisation by the relevant provider. We may request information reasonably necessary to verify a transaction or prevent fraud.
4.5 Where international delivery is offered, any responsibility for customs duties or import charges will be explained before purchase so that you can assess the cost of your order.
SECTION 5 — SHIPPING, DELIVERY AND RISK
5.1 Available delivery arrangements, charges and any stated dispatch or production times will be provided during the ordering process. Estimated delivery dates are estimates unless a particular date has expressly been agreed as binding. This distinction does not remove any statutory delivery deadline or remedy.
5.2 If we become aware of a delay, we will take reasonable steps to inform you and explain the available options. Delays involving carriers or events beyond our control do not automatically remove our responsibility to you or your rights to cancel or obtain a refund where the law provides for them.
5.3 For consumer orders delivered by a carrier offered or arranged by us, the goods remain at our risk until they come into your physical possession, or that of a person you identify to receive them. If you independently commission a carrier that we did not offer, the statutory rules governing that arrangement apply.
5.4 Please provide a complete and accurate delivery address. If goods do not arrive or arrive damaged, contact us so that we can investigate and provide the appropriate resolution.
SECTION 6 — INTELLECTUAL PROPERTY
6.1 The website design, branding, text, photographs, graphics, video, audio and other materials made available through the Services are owned by, or licensed to, Lalala Fashion or their respective rights holders. They are protected by applicable intellectual property law.
6.2 You may access the Services for personal, non-commercial purposes and retain copies of order information and these Terms for your records. Except where permitted by law or with the relevant rights holder’s written permission, you must not reproduce, redistribute, commercially exploit or create derivative works from protected content.
6.3 Access to the Services does not transfer ownership of any intellectual property or grant a licence to use our branding commercially. Shopify’s names and marks remain its property. Other third-party names and marks remain the property of their respective owners.
SECTION 7 — OPTIONAL THIRD-PARTY TOOLS
7.1 Certain features may be supplied by independent third-party providers and may be subject to their own terms. Before using an optional tool, please review any conditions and charges disclosed by its provider.
7.2 We do not control every aspect of independently operated tools and cannot promise their uninterrupted availability. However, the use of a third-party provider does not exclude any responsibility we retain for services we have agreed to supply or for our own acts or omissions.
7.3 Additional features introduced through the store will be subject to these Terms and any relevant conditions presented before use.
SECTION 8 — THIRD-PARTY LINKS AND CONTENT
8.1 The Services may contain links to independently operated websites or third-party content. A link does not, by itself, constitute an endorsement of the provider or its products. Please review the provider’s terms and privacy information before entering into a separate transaction.
8.2 Queries concerning products purchased directly from another provider should ordinarily be addressed to that provider. Nothing in this section excludes our responsibility for our own representations or for obligations arising from a purchase made with Lalala Fashion.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
9.1 Lalala Fashion uses Shopify’s platform to operate the online store. Purchases made from Lalala Fashion are transactions with Lalala Fashion; Shopify does not become the seller merely because it supplies the platform.
9.2 Lalala Fashion is responsible for fulfilling its obligations as the seller, including handling order enquiries and applicable returns or remedies. Please direct such enquiries to us using the contact details in Section 25.
9.3 Any separate service supplied to you by Shopify may be governed by its own terms. This section does not release any person from liability that cannot lawfully be excluded.
SECTION 10 — PRIVACY AND PERSONAL INFORMATION
10.1 Our Privacy Policy (https://lalalafashion.co.uk/policies/privacy-policy) explains the purposes for which we collect and use personal information, the parties with whom it may be shared and the rights available to you.
10.2 Shopify also processes information in connection with hosting and providing the store platform. Its applicable privacy information is available at https://www.shopify.com/legal/privacy/app-users.
10.3 Information may be processed by service providers outside your country of residence, as explained in the applicable privacy notices. These Terms do not constitute blanket consent to marketing or to processing that requires a separate legal basis or permission.
SECTION 11 — REVIEWS, FEEDBACK AND SUBMITTED CONTENT
11.1 If you submit a review, suggestion or other content for publication or consideration (“Feedback”), you must have the necessary rights to provide it. Feedback must be truthful where presented as fact and must not infringe another person’s intellectual property, privacy or other legal rights. Any incentive received for a review should be disclosed.
11.2 By submitting Feedback, you grant us a non-exclusive, worldwide, royalty-free licence to reproduce, display and reasonably adapt it for the purposes of operating, improving and promoting the Services. This includes allowing service providers to process it on our behalf. Adaptation must not misleadingly alter its meaning. Personal information remains subject to our Privacy Policy and applicable law.
11.3 We may remove or decline to publish content that is unlawful, abusive, fraudulent, irrelevant or infringes another person’s rights. You must not submit malicious software, impersonate another person or misrepresent the origin of your content.
11.4 Unless separately agreed, submitting Feedback does not create an entitlement to payment or require us to implement a suggestion. Content submitted privately as an order enquiry or complaint is not automatically treated as permission to publish it as a testimonial.
SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS
12.1 We may correct typographical errors or inaccuracies in product information, availability, pricing or delivery details. If an error affects an order you have submitted, we will contact you where necessary to explain the correction and any available options.
12.2 We will not treat a website correction as your agreement to a higher price or a materially different product. Where an order cannot proceed, any cancellation and refund will be handled consistently with the contract and applicable law. This section does not grant an unrestricted right to cancel accepted orders.
SECTION 13 — PROHIBITED USES
13.1 You must use the Services lawfully and must not engage in fraud, harassment, impersonation, infringement of intellectual property, misuse of personal information or the distribution of unlawful or malicious content.
13.2 You must not interfere with the operation or security of the Services, introduce harmful software, circumvent access controls, obtain unauthorised access to accounts or send unsolicited promotional communications through the Services.
13.3 Unauthorised commercial scraping, bulk extraction or resale of website content is prohibited. Automated access is also subject to Section 14. Nothing in this section prohibits ordinary personal browsing, assistive technology or activity protected by law.
13.4 Where we reasonably believe misuse has occurred, we may take proportionate steps to protect the Services, including restricting access. Any action affecting an account remains subject to Section 15 and does not remove rights relating to an existing purchase.
SECTION 14 — AUTOMATED AGENTS
14.1 An “Agent” means software or a service that accesses or interacts with the Services autonomously or semi-autonomously on behalf of a person or organisation.
14.2 Agents must identify their automated nature and must not misrepresent themselves as human users. Where they make HTTP or HTTPS requests, the user-agent information must identify the Agent using “Agent/[agent name]”.
14.3 Agents must not bypass CAPTCHAs, security controls or measures governing automated access, conceal their identity, or continue access after being instructed to stop. Responses to enquiries concerning whether an interaction is automated must be truthful.
14.4 We may impose reasonable technical restrictions to protect security, availability and the proper operation of the Services. An Agent’s compliance with identification requirements does not authorise otherwise prohibited conduct or permit a purchase without the customer’s authority.
SECTION 15 — SUSPENSION AND TERMINATION
15.1 We may suspend or terminate access where reasonably necessary to address a serious breach of these Terms, fraud, security risks or unlawful activity. Where appropriate, we will provide notice and an opportunity to resolve the issue; immediate action may be necessary where delay would create a material risk.
15.2 Ending access to an account does not, by itself, cancel an accepted order, extinguish a refund entitlement or remove rights that have already arisen. Any outstanding lawful payment obligations remain payable.
15.3 Provisions concerning intellectual property, accrued rights, liability, dispute resolution and other matters intended to continue after termination will remain effective to the extent relevant.
SECTION 16 — WEBSITE AVAILABILITY AND PRODUCT OBLIGATIONS
16.1 We take reasonable care in operating the Services but cannot guarantee that website access will always be uninterrupted or free from technical errors. Temporary interruptions may occur because of maintenance, updates or technical difficulties.
16.2 General editorial content is provided for information. This does not diminish the contractual significance of product descriptions or information on which you are entitled to rely when purchasing.
16.3 Goods supplied to consumers must meet applicable statutory standards, including satisfactory quality, fitness for any applicable purpose and conformity with their description. Services must be supplied with reasonable care and skill. We do not sell consumer goods on terms that exclude these obligations by describing them as supplied “as is”.
SECTION 17 — LIABILITY
17.1 We are responsible for loss or damage that is a foreseeable consequence of our breach of contract or failure to exercise reasonable care and skill. Loss or damage is foreseeable where it is an obvious consequence or was reasonably contemplated by both parties when the contract was made.
17.2 The store is intended for personal and household purchases. We do not undertake responsibility under these consumer Terms for business losses arising from commercial use, such as lost business profits or business opportunities.
17.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Your statutory rights concerning goods and services remain unaffected.
SECTION 18 — RESPONSIBILITY FOR MISUSE AND THIRD-PARTY CLAIMS
18.1 If your unlawful conduct or breach of these Terms causes us loss, any claim we make will be subject to applicable law and limited to losses for which you are legally responsible. You are not required to compensate us merely because you use the Services or make a legitimate complaint.
18.2 Where a third-party claim arises from content you submitted or conduct for which you may be responsible, we will provide reasonable information about the claim and an opportunity to respond. This section does not require you to pay for losses caused by our own breach or negligence, or automatically accept a settlement or legal costs incurred without appropriate justification.
SECTION 19 — SEVERABILITY
19.1 If a court or other competent authority determines that a provision is unlawful or unenforceable, that provision will not bind you to the extent of that determination. The remaining provisions will continue to apply where the contract can reasonably operate without the affected provision.
SECTION 20 — WAIVER AND CONTRACT DOCUMENTS
20.1 A delay or failure to exercise a right does not, by itself, amount to a permanent waiver of that right. Any waiver relating to a particular matter does not automatically apply to another matter.
20.2 These Terms, the relevant order details and any applicable terms disclosed and agreed before purchase form the contractual arrangements for your order. Nothing in this section excludes information, representations or obligations that form part of the contract by law, or limits liability for misrepresentation where it cannot lawfully be limited.
20.3 These Terms will be interpreted in accordance with applicable law, including the rules protecting consumers where contractual wording is ambiguous.
SECTION 21 — TRANSFER OF RIGHTS AND OBLIGATIONS
21.1 If you wish to transfer contractual rights or obligations to another person, please contact us. We will consider the request reasonably and will not restrict a transfer that the law entitles you to make.
21.2 We may transfer our contractual rights or obligations as part of a legitimate business transfer, provided that this does not reduce your contractual protections or materially prejudice your rights. We will notify you where the transfer affects your order or the party responsible for fulfilling it.
SECTION 22 — GOVERNING LAW AND DISPUTES
22.1 These Terms of Service and any separate agreements under which we provide our Services are governed by the laws of England and Wales.
Any disputes will be subject to the jurisdiction of the courts of England and Wales, except that consumers may also rely on any mandatory rights or protections available in the country where they live.
22.2 Please first contact contact@lalalafashion.co.uk with details of a complaint so that we can seek to resolve it. Doing so does not prevent you from exercising a legal remedy or commencing proceedings within an applicable time limit.
22.3 Disputes may be brought before a court with jurisdiction under applicable law. Nothing in these Terms requires a consumer to use a court or dispute procedure that removes a right to bring proceedings elsewhere where the law permits.
SECTION 23 — HEADINGS AND INTERPRETATION
23.1 Headings and clause numbers are included to assist navigation and do not override the meaning of the accompanying provisions. References to policies mean the policies made available in connection with the relevant transaction, subject always to statutory rights.
SECTION 24 — CHANGES TO THESE TERMS
24.1 We may revise these Terms to reflect changes in the Services, business arrangements or applicable law. Updated terms will be published on the website, and material changes will be communicated where required.
24.2 An order will ordinarily remain governed by the terms applicable when it was accepted. We will not retrospectively impose a material change on an existing order without your agreement, except where a change is required by law.
24.3 Please review the current Terms before making a new purchase. Publication of revised terms does not remove rights arising under an earlier contract.
